EPA labels milk environmental hazard

Looking for a way to get farmers politicized? Read on. Rules put forth by the Environmental Protection Agency (EPA) under the presumably infallible Clean Water Act have the potential to harm every farmer who has significant fuel storage on the farm. But dairy farmers should pay particular attention, since the EPA apparently intends to classify milk as a hazard to the waters of the United States and add tremendous compliance costs and regulatory burdens.

“This is beyond the original intent of the law,” said Andy Kok, legal counsel with Michigan Farm Bureau. “If we had examples of dairy bulk tanks leaking and producing fish kills, we might understand it. But this is just one more example of a well-intentioned law that EPA regulators will go beyond to churn out a rule absent the balance of common sense.”

Tied to the Clean Water Act is a separate program called the Oil Spill Prevention, Control and Countermeasure Program. Its goal, according to the EPA, is to “prevent oil spills into waters of the United States and adjoining shorelines…. A key element of this program calls for farmers … to have an oil spill prevention plan, called an SPCC plan.”

Sounds reasonable on the surface, Kok said, and at first glance it also seems reasonable to assume that farmers won’t really be affected much, since a farm cannot be under the rule’s thumb unless it does three things: It must store, transfer or use oil; it must have the capacity to store more than 1,320 gallons of oil in aboveground tanks or 42,000 gallons in below-ground tanks, and it must “reasonably be expected to discharge oil to waters of the U.S.”

Those are very specific criteria, and most Michigan farmers would think they’re exempt. But milk, according to the EPA, is considered oil, and therefore dairy farmers can much more easily reach the 1,320 gallon criteria.

Why is milk considered oil?

“Milk typically contains a percentage of animal fat, which is a non-petroleum oil,” the EPA rule says. “Thus, containers storing milk are subject to the SPCC rule when they meet the applicability criteria…”

When we apply some general assumptions to the rules, things get sticky even for small farmers. If a farm has no fuel storage tanks to add into the equation, and if a milk bulk tank can be regulated beginning at the capacity to hold 1,320 gallons; and if we assume a 70 pound-per day per cow production average at roughly 8 pounds per gallon, or 8.75 gallons per cow per day, that means a farmer milking 150 cows could be regulated yet again, this time under the SPCC if milk is picked up every day. For every-other-day pickup, cut the regulated herd size to 75 cows.

That’s a pretty significant overreach by the government, Kok said, particularly since the act that created the SPCC is very obviously intended to deal with petroleum-based oil spills.

Further muddying the issue, said Paul Schlegel, director of public policy with the American Farm Bureau Federation, is that EPA has few answers either.

“We tried to tell the EPA three or four years ago that farms are not a problem and to rope us into the rule is senseless,” he said. “EPA’s position is that farms are not exempt by law, and that they in effect were making more flexibility for the fact that farms have different circumstances, but they also contend they have no ability to write farmers out completely.”

With that as a caveat, the EPA proposed an exemption for farmers under the SPCC. But that was in the waning days of the Bush Administration, and when the Obama Administration took over, Schlegel said, EPA pulled back the rule in keeping with Obama’s promise to reexamine every Bush policy.

“The Obama Administration pulled back the rule in January of 2009, then reissued it in November, and to large degree it was the same rule,” Schlegel said.

If the Obama EPA was willing to give famers a break on the oil spill rule, it has shown no effort to do it. In fact, farmers are expected to be in compliance under the law this November, although there has been talk of extending the compliance date.

Farmers – many whom are not in compliance but are already required to be – have no assistance available and no department personnel to help them comply, said Allen Krizek, MSU Extension liaison with the Michigan Department of Agriculture. He’s also involved with the state’s Water Stewardship Program.

Without enforcement or guidance, complying is even more complicated than the rule, if that’s possible. If a farm’s cumulative storage capacity of oil – that includes diesel fuel tanks, oil storage containers and milk bulk tanks – is less than 10,000 gallons and there has never been a spill, the owner can self-certify by filling out a 20-page EPA “template.” If those conditions do not apply, the farm response plan must be certified by a professional engineer. Kok said a quick call revealed one engineer whose SPCC preparation fee begins at $2,500.

Hopefully, the issue will become a little easier to handle, since the National Milk Producers Federation is preparing its own 20-page template specifically for dairymen. But what are farmers to do in the meantime? Hold tight at this point and take measures to get the EPA to move forward with the exemption it originally proposed.

“There has been talk of an exemption, but I’m not sure if it will go through,” said Dr. Barb Carr, SPCC coordinator with the EPA’s Region 5 office. If it does not, she said, farmers are expected to be in compliance with the rules by Nov. 10, and they will be held to that deadline. But only the rules that were added in 2002 apply, not the rules that were included in the original 1973 rule.

The bottom line is that farmers are not exempt, she said, noting that she will be happy to speak to farmers, and they should not be afraid of talking to her.

“They can call me anonymously,” she said. “I’m not going to use their call to start an enforcement action. I just want them to have the right information and be sure they understand. A lot of this is just common sense, and I’ll spend three hours with them if I need to.”

Farmers also can get more information and guidance on the Web at www.epa.gov\oilspill, although Schlegel said it’s not all that easy.

“The links provided on the EPA Web site don’t answer our questions,” Schlegel said. “So at this point, we just need to get the word out that this is coming, and hope farmer response is enough to get the exemption moving.”

There is no question, Schlegel said, that if the government goes ahead with the rule, federal jurisdiction over farms will “spread exponentially.” And that, farmers fear, is more than an unintended consequence.

It’s also unnecessary, Kok said.

“If a farmer spreads milk on his fields or drives his tractor through the milk house into the bulk tank and it spills into surface water, that’s an illegal discharge,” he said. “The farmer will have to clean it up. It’s already a covered issue.”

“Agenda 21 is the official report of the United Nations Rio de Janeiro World Summit Conference of 1992, which was built on the premises of General Assembly resolution 44/228 of 22 December 1989, which was adopted when the nations of the world (?) called for the United Nations Conference on Environment and Development.

It is a plan that calls for the international control and regulation of virtually every aspect of human activity that might impact the environment, which is essentially everything humans do.

It is one of the most arrogant statements of government ever conceived, for it literally assumes that man can recreate the Garden of Eden (but only if he has sound direction from a world governing body). A partial list of chapter titles should give you a hint of what this document is all about:

  • Chapter 3, Combating Poverty
  • Chapter 4, Changing Consumption Patterns
  • Chapter 6, Protecting and Promoting Human Health
  • Chapter 24, Global Action for Women Towards Sustainable Development
  • Chapter 25, Children and Youth in Sustainable Development
  • Chapter 29, Strengthening the Role of Workers and Their Trade Unions
  • Chapter 30, Strengthening the Role of Business and Industry

Admittedly, much of what is discussed is worth while, and we all should be concerned with the environmental conditions we create for ourselves and our posterity. But there is a great deal of scientific evidence that indicates the conditions are far from being the critical problem they are being portrayed as; that much of the so-called evidence being relayed to the public is based on less than scientific assumptions, and is being used to frighten people into accepting controls over their lives they would otherwise resist.

Even if most of the claims being made were valid, would it be appropriate to turn the sovereignty of nations over to some unelected world body that will exercise dictatorial powers over the nations’ populations?

We do not think so. We still believe it is in the best interest of the American people to have a government that is — of the people, by the people and for the people, — not one that would be accountable to no one but itself. That is exactly the kind of government the United Nations is trying to establish, and Americans are being kept in the dark about it by their own elected officials and a news media that is in sympathy with the global ethos.

We offer the following verbatim quotations from Agenda 21 in the hope that it will help give you some understanding of the character of those behind this movement. Color is added for emphasis.

  • This partnership commits all States [read Nations] to engage in a continuous and constructive dialogue, inspired by the need to achieve a more efficient and equitable world economy. [Ch. 2, Para. 2.1]         
  • consensus-building at the intersection of the environmental and trade and development areas will be ongoing in existing international forums, as well as in the domestic policy of each country. [Ch. 2, Para. 2.4]         
  • The removal of existing distortions in international trade is essential. (Ch. 2, Para. 2.7)         
  • Provide for an equitable, secure, non-discriminatory and predictable international trading system; [Ch. 2, Para. 2.10(b)]

  • Sustainable development must be achieved at every level of society. [Ch. 3, Para. 3.7]

  • Without the stimulus of prices and market signals that make clear to producers and consumers the environmental costs of the consumption of energy, materials and natural resources and the generation of wastes, significant changes in consumption and production patterns seem unlikely to occur in the near future.   • Population data should be disaggregated by, inter alia, sex and age in order to take into account the implications of the gender division of labor for the use and management of natural resources. [Ch. 5, Para. 5.28]

  • Proposals should be developed for local, national and international population/environment programmes in line with specific needs for achieving sustainability. [Ch. 5, Para. 5.56]
  • Governments should take active steps to implement programmes to establish and strengthen preventive and curative health facilities which include women-centred, women-managed,safe and effective reproductive health care and affordable, accessible services, as appropriate, for the responsible planning of family size… [Ch. 6, Para. 6.26]
  • The health and well-being of all urban dwellers must be improved so that they can contribute to the economic and social development. [Ch. 6, Para.6.33]         
  • As a first step towards the goal of providing adequate shelter for all, countries should take immediate measures to provide shelter to their homeless poor … [Ch. 7, Para. 7.9(a)]         
  • All countries should … Formulate appropriate land-use policies and introduce planning regulations specially aimed at the protection of eco-sensitive zones against physical disruption by construction and construction-related activities. [Ch. 7, Para. 7.69(d)]
  • Monitoring and evaluating the development process systematically, conducting regular reviews of the state of human resources development, economic and social conditions and trends, the state of the environment and natural resources; [Ch.8, Para. 8.4(d)]
  • Laws and regulations suited to country specific conditions are among the most important instruments for transforming environment and development policies into action, not only through “command and control” methods, but also as a normative framework for economic planning and market instruments. [Ch. 8, Para. 8.13]         
  • …since the transport sector is also a source of atmospheric emissions, there is a need for a review of existing transport systems and for more effective design and management of traffic and transport systems. [Ch. 9, Para. 9.13]

Someone called in from Save our State, a California group that has been fighting against illegal immigration for years.  Someone mentioned Rip Van Winkle and how the masses are asleep and I agree. One of the callers talked about the California EPA standards for fireplace use. Did you know that there are four stages for burning? 1. burn on only approved days, 2.burn discouraged, 3.burn prohibited unless using an approved burning device, 4. no burn I think you won’t be burning much, henceforth.

My View of the Klamath Dams Controversy By Congressman Wally Herger 

I have always been – and continue to be – a fervent supporter of dams. I believe we need more dams, not fewer. They are invaluable because of their many benefits, including as a source of abundant and cheap electricity, protection from flooding, and recreational opportunities (including the economic benefits they create) for local communities. Unfortunately, decades of increasing environmental regulation have created skyrocketing costs and potential liabilities for existing dam owners. It’s a problem we are seeing play out across the West and indeed right here in our own backyard as four dams on the Klamath River are currently being considered for removal because the environmental costs and risks of continued operation have become so high. The debate over these four Klamath River dams has become a big issue in our area. Constituents I have known and worked with for many years are sharply divided on it.  

Farmers in Tulelake in Siskiyou County have been fighting regulatory battles like these for years. Indeed, in 2001 their area was ground zero for a national battle over the inflexible Endangered Species Act (ESA), as farmers there had all of their irrigation water abruptly shut off in a decision that was later determined to be not justified by science. It is these same farmers who have been working to take the best advantage of a settlement agreement that they fervently hope will provide them the regulatory certainty they need to survive. They are hardly cheerleaders for dam removal. But they have concluded that giving up certain dams that create hydropower but do not store agricultural water is a trade-off they are willing to make in exchange for what they hope will stop the endless regulatory and court battles over their water supplies. If I were in their position, I would be advocating for the same settlement agreement to have a more secure economic future. 

There is a wider community sentiment that strongly opposes dam removal. This was reflected in a lopsided but legally nonbinding referendum. This emotionally charged issue is further complicated by the fact that, at its core, dam removal in this case involves a private property right. PacifiCorp, the owner of the dams, has reluctantly made a tentative business decision to remove their dams. They indicated to me that they did not reach this decision lightly. But, to be blunt, the company had a regulatory gun pointed at its head. 

It is not that the dams are structurally deficient; the problem is that they cannot meet current state and federal laws and regulations. As PacifiCorp moved through the relicensing process, they realized they would be required to spend hundreds of millions of dollars for fish ladders and other mitigation, and yet it was still unclear whether they would receive a vital permit required under the Clean Water Act. Faced with this prospect, PacifiCorp decided to cut its losses. (The negotiated settlement allows them to cap their costs at $200 million. Seeking to relicense the dams would far more than double that cost which, under current law, would be passed on to ratepayers. 

That said, dam removal is by no means a “done deal.” The “Agreement in Principle” requires a $250 million contribution from the State of California. Given the acute fiscal crisis facing California, such funding is by no means assured.

Furthermore, the Klamath River Expert Panel (a scientific “peer review” panel convened by the Department of Interior) recently concluded that current studies are deficient in addressing a host of subjects. A June story in the Los Angeles Times was headlined: “Scientists find holes in Klamath River dam removal plan.” The opening sentence bluntly noted, “A $1.4-billion project to remove four hydroelectric dams and restore habitat to return Chinook salmon to the upper reaches of the Klamath River amounts to an experiment with no guarantee of success, an independent science review has concluded.” 

Bear in mind that the Department of Interior asked for this review. I contacted Interior Secretary Salazar in late August and asked him to respond to the Expert Panel’s scathing criticisms, but I have still received no reply. Before the Secretary renders a decision on dam removal, and before the Congress is asked to expend roughly a billion dollars to implement a “restoration” program, it might be a good idea to make sure that the plan will not be a colossal failure.  

If the science does not justify the proposal to remove the dams, or if the cost/benefit ratio is so out-of-kilter that it does not pass the straight face test, then PacifiCorp should be owed the opportunity to seek a new license that contains reasonable and affordable conditions. But the bottom line is we must continue working to reform the environmental laws that are making life so difficult and costly for farmers and energy producers alike.

       Group manipulation tactics.  Do you know you are being manipulated? Few people do and why would you?  You wouldn’t. And manipulators are trained and skilled at manipulation. Slick is a word that describes them.

       Before you volunteer for that curriculum committee, school violence task force or focus group; before you run for school board or PTA president: Find out who the professional manipulators are and how they’re going to get you to stick your foot in your mouth. There is a hands-on workshop in strategies used to silence parents and concerned citizens and generate a predetermined consensus on controversial issues.

     Beverly Eckman joins me again today to discuss how to combat professional agitators, facilitators, moderators, and provocateurs. We discussed how terms are redefined and no longer mean what they did originally.  We discussed political correctness and the manipulation of children in our education system. Beverly references an 1895 8th grade test which none of us could pass. She is the author of several articles and books including, “How to Counter Group Manipulation Tactics: The Techniques of Unethical Consensus-Building Unmasked.”

Did you know that Clinton’s 1995 Paperwork Reduction Act meant that the hundreds of millions of YOUR tax dollars spent on litigation brought by environmental groups (which ultimately goes into their coffers), is no longer accounted for?

Most Americans are unaware of how their property rights are being eroded. In fact, they won’t find out until they attempt to use their property as they see fit, then the sledge hammer will drop.
